Implementation of the norms of the dogs’ euthanasia law, mutilated by the city mayors to the detriment of the citizens and the benefit of the mayors

Apart from his visits to the Parliament of Romania, to seek reassurance that the dogs’ killing has become legal again, the Mayor of Pitesti, Mr. Tudor Pendiuc, in his capacity of Chairman of the Romanian Municipalities Association (AMR), has continued this kind of actions and now even makes pressures to amend the implementation norms of the said law, such as they were issued by ANSVSA (National Sanitary Veterinary and Food Safety Authority). Only a few days ago, ANSVSA took for granted all the wishes of AMR, which are now mutilating the norms without any logic at all, and do a disservice to the citizens, animals, local budgets, except for the city halls only, and the persons directly involved in this action, which get much benefit from this!

Now the city halls are no longer satisfied with their own dogs! They fight for more dogs!

Anyone might wonder what would be the interest of AMR to amend the norms so that a city hall could be entitled to catch dogs from other localities, too, have them transported to their own place and kill them in their own shelters.

Anyone might wonder where is the rationale in adopting the hypocritical slogan according to which this law is for “adoption”, and not for “killing” (even if killing is an outcome of the 14-day term stipulated). As a matter of fact, adoptions are restricted as much as possible, not to say totally: for instance, AMR required a drastic reduction in the adoption and claim program, probably after the Pitesti model (where we speak of 2 hours a week and only in the mornings and working days, when most people cannot leave their jobs!).

Besides, the mayors are not particularly interested, as a priority, in catching aggressive and dangerous dogs, or packs of stray dogs.

Therefore, the mayors are not interested in catching the trouble dogs, as the management services were originally required to act through the implementations norms. As a result, AMR removed this provision.

Onerous contracts remain “legal”

In order to reduce the onerous contracts as much as possible, the norms mentioned that ANSVSA was supposed to publish on their website a price-list of estimate costs for food, medication, etc., at the market value. Now AMR makes an amendment: they may publish the list, but only “for information purposes”! This way, they open a door for the city councils to sign contracts with favourite companies, for the procurement of services and products at exorbitant prices.

Considering that stray dogs’ mass killing has been already proven not to give good results, but on the contrary, to maintain the problem, it is now more and more obvious that this stray dogs’ affair is a business created artificially, and therefore in the interest of many city councils to have dogs

Die Bestimmungen zur Anwendung des Euthanasiegesetzes wurden durch die Bürgermeister zu Lasten der Bürger und Tiere und zu Gunsten der Bürgermeister geändert

Zusätzlich zu den Besuchen beim Parlament, um sicherzustellen, dass die Tötung der Hunde erneut gesetzmäßig wird, hat der Bürgermeister von Pitesti, Tudor Pendiuc, als Vorsitzender des Großstädteverbandes Rumäniens (AMR) seine Initiativen in diesem Bereich fortgesetzt und Druck gesetzt, um Änderungen der Normen über die Anwendung des Gesetzes, welche durch die Nationale Behörde für Tier- und Lebensmittelschutz - ANSVSA ausgestellt wurden, zu fördern. Vor nur einigen Tagen hat ANSVSA sämtliche Wünsche der AMR übernommen, wobei dadurch ohne jede Logik die Vorschriften geändert und große Schäden den Bürgern, den Tieren, den Kommunalbudgets verursacht, aber gleichzeitig erhebliche Vorteile den Bürgermeistern und den Einrichtungen, die unmittelbar beteiligt sind, sichergestellt werden !

Für die Rathäuser sind die Hunde in den eigenen Städten nicht genug! Sie kämpfen, um über mehr Hunde zu verfügen!

Jeder konnte sich fragen, wo das Interesse von AMR liegt, die Vorschriften zu ändern, so dass ein Rathaus berechtigt wird, Hunde auch in anderen Orten zu fangen, in der eigenen Stadt zu befördern und in den eigenen Tierheimen zu töten, liegt.

Jeder würde sich fragen, wo die minimale Begründung des unwahrhaftigen Mottos, dass das Gesetz die “Adoptionen” und nicht die “Tötungen” (auch wenn diese Maßnahme nach 14 Tagen getroffen wird) fördert, liegt. In der Tat sind die Adoptionen so stark beschränkt, dass sie fast unmöglich sind: demzufolge wünscht AMR die drastische Kürzung des Programms für Adoptionen und Zurückforderungen, wahrscheinlich aufgrund des Modells, das in Pitesti anwendbar ist (d.h. 2 Stunden/Woche und nur morgens und während der Arbeitstage, wenn die meisten Personen arbeiten!).

Die Bürgermeister haben kein Interesse, prioritär die aggressiven und gefährlichen Hunde, die Rudel, zu fangen.

Die Bürgermeister haben kein Interesse, sich erstens um die Problemhunde, gemäß deren Pflichten aufgrund der Anwendungsvorschriften, zu kümmern, so dass AMR diese Bestimmung aufgehoben hat.

Die gewinnbringenden Verträge bleiben “gesetzmäßig”

Um die Anzahl der gewinnbringenden Verträge so stark wie möglich zu verringern, war durch die Vorschriften vorgesehen, dass ANSVSA auf der Webseite die Preisliste mit den Schätzkosten für Futter, Arzneimittel, aufgrund der Marktpreise, zu veröffentlichen hat. AMR hat folgende Änderung umgesetzt: die Auflistung dient nur „zur Information”! Demzufolge haben die interessierten Rathäuser die Möglichkeit, Verträge mit den gewünschten Unternehmen über den Ankauf von Lieferungen und Leistungen für übertriebene Preise abzuschließen.

Da schon nachgewiesen wurde, dass die Massentötung wirkungslos ist und das Problem weiterführt, ist das Geschäft in Zusammenhang mit den Straßenhunden und das Interesse vieler Rathäuser, dass diese Tiere ständig auf der Straße sind, eindeutiger.

Pe langa vizitele efectuate pe la Parlament pentru a se asigura ca uciderea cainilor devine din nou legala, in calitate de presedinte al Asociatiei Municipiilor din Romania (AMR), primarul Pitestiului, Tudor Pendiuc, si-a continuat initiativele de acest tip exercitand acum presiuni pentru modificari la normele de aplicare a legii, norme emise de ANSVSA. In urma cu doar cateva zile ANSVSA-ul inghite toate dorintele AMR care mutileaza astfel normele, fara nicio logica, aducand mari deservicii cetatenilor, animalelor, bugetelor locale dar mari servicii primarilor si celor implicati direct!

Primariile nu se multumesc cu numarul de caini din orasul propriu! Se lupta pentru mai multi!

Oricine s-ar intreba care este interesul AMR sa modifice normele astfel incat o primarie sa aiba dreptul sa captureze caini si din alte localitati, sa-i transporte in orasul propriu si sa-i omoare in adapostul propriu.

Oricine s-ar intreba unde ar mai putea fi minima justificare a adoptarii sloganului ipocrit precum ca legea este una a “adoptiei” si nu una a “uciderii” (chiar daca aceasta se face dupa 14 zile). In realitate, adoptiile sunt restrictionate cat de mult posibil spre deloc: astfel AMR impune scurtarea drastica a programului de adoptie si revendicare, probabil dupa modelul Pitesti (adica 2 ore/saptamana si numai in cursul diminetii si numai in zilele lucratoare cand majoritatea nu se pot deplasa!).

Pe primari nu-i intereseaza nicicum prinderea cu prioritate a cainilor agresivi si periculosi, a haitelor.

Primarii nu sunt interesati sa fie prinsi in primul rand cainii care deranjeaza, asa cum erau obligate serviciile de gestionare, prin normele de aplicare, astfel ca AMR-ul a scos aceasta prevedere.

Contractele oneroase raman “legale”

Pentru a reduce pe cat posibil contractele oneroase, in norme se mentiona ca ANSVSA va afisa pe site lista de preturi pentru costurilor estimative pentru hrana, medicamente, conform preturilor de pe piata. AMR-ul modifica: lista poate fi, insa doar cu titlu „informativ”! Ramane astfel aceeasi usa deschisa pentru primariile interesate, de a incheia contracte cu firme favorite pentru achizitionare de servicii si produse la preturi exorbitante.

Avand in vedere ca oricum este deja dovedit faptul ca uciderea in masa nu da rezultate ci dimpotriva mentine problema, devine si mai evidenta afacerea creata in jurul maidanezilor si deci interesul multor primarii sa-i avem permanent in strada.

Implementation of the Rules of the Law 258/2013

the implementation of the Rules of the Law 258/2013 have not yet been approved by the Government, but since many of you asked me for an update, including the context in which on December 5, 2013 at the Romanian Embassy in Vienna will be the presentation of the rules, I think the most important issues highlighted at the moment are:

  1. In developing rules, animal protection organizations were not consulted. There was only a " hearing" for their opinions but without the inclusion of the proposed amendments.
  2. The Rules do not change the 14 day period before euthanasia!
  3. Although despite these rules there would not be a possibility of capturing neutered, gentle, peaceful dogs, cared for by citizens, this will not happen and all dogs will be captured. The only exception are those who are in enclosed spaces, which otherwise do not exist since it is forbidden to build pens in addition to blocks!

The law requires the sterilization of dogs with owners - a good thing to provide - but the absence of other provisions will lead to a disaster because:

  • In Romania there are at least 5 million ‘owned‘ dogs! It is impossible to sterilize all dogs within 12 months - there are not enough doctors who have offices and who know how to sterilize.
  • Many doctors who can not sterilize, will commit to do so, and the result is often the death of females. For example, in Arges (a county near Pitest ) an unqualified doctor hired by the major 'sterilized' all females (about 500) and who died after days of agony in the streets. I filed a criminal complaint and I complained to the Ethics Committee of the College of Veterinarians but as it unfolds, despite all declarations, medical certificates from other veterinarians, samples, pictures, videos, it seems that the doctor is "not guilty " and will continue to kill dogs by sterilization
  • The rules do not provide any financial support from the government for the sterilization of dogs. There is a minimum of 4 million 'owned‘ dogs in rural areas where people do not have the financial possibilities and where the dog in the yard is not regarded as important, for which to prevent fine, most dogs will be abandoned in bags tied to trees in forests, thrown into disused wells, into streams, as is the ancient practice of those who become useless.

Authorities initiate propaganda to try to manipulate the population into believing that the law 258/2013 is the "Law of Adoption " and NOT a "Slaughter Law" but in reality :

  • Dozens of people stand at the gates of shelters to adopt dogs captured from the street but they are not allowed to adopt
  • The law provides that if you adopt more than two dogs, you must have the permission of a tenants association and neighbors
  • Houses of animal lovers are already full of dogs rescued from the streets, and cannot absorb hundreds of thousands of dogs
  • Some mayors harass people who have animals in the house, going after them and fining them on behalf of local by-laws and you can not adopt your pet without the consent of neighbors and anyway you can not have more than two pets

Who does not sterilize their dog within 12 months will pay a fine of up to 2,500 euros (net average salary in Romania is 350 Euro!) :

Authorities deliberately suggest that the animal lovers have responsibility for the euthanasia of dogs which have not been adopted in the requisite 14 days! This will seek to place responsibility for the euthanasia onto animal lovers because the dogs were not adopted!

Umsetzungsverordnung des Gesetzes 258/2013

Die Umsetzungsverordnung des Gesetzes 258 wurde noch nicht von der Regierung genehmigt. Da aber viele von Ihnen mich um ein Update gebeten haben, auch im Kontext, in dem am 5. Dezember 2013 an der rumänischen Botschaft in Wien die Präsentation der Umsetzungsverordnung stattfinden soll, möchte ich die wichtigsten Themen hervorheben, und zwar:

  1. Bei der Festlegung der Regeln, der sogenannten 'norms', wurden keine Tierschutzorganisationen konsultiert. Es gab lediglich eine Anhörung jedoch ohne, dass die vorgeschlagenen Änderungen in die Umsetzungsverordnung eingefloßen sind.
  2. Die Regeln werde die 14 -Tage-Frist vor der Euthanasie NICHT ändern!
  3. Obwohl mit diesen Regeln die Möglichkeit gegeben wäre kastrierte, sanfte, ruhige Hunde, die sich in privater Haltung befinden, auszuschließen, wird dies nicht geschehen und ausnahmslos alle Hunde werden eingefangen werden. Die einzige Ausnahme sind die, die in geschlossenen Gehegen, die eigentlich generell nicht existieren, da es verboten ist solche neben Wohnblöcke zu bauen!

Das Gesetz verlangt die Sterilisation von Hunden mit Eigentümern - was an und für sich natürlich lobenswert ist - jedoch in Abwesenheit sonstiger Regelungen dies zu folgendem Szenario führen wird:

  • In Rumänien gibt es mindestens 5 Millionen Hunde in privater Haltung! Es ist unmöglich, alle Hunde innerhalb von 12 Monaten zu sterilisieren - es gibt nicht genug Tierärzte die die notwendigen Räume und Erfahrung haben diese Hunde zu sterilisieren
  • Viele Ärzte, die keine Erfahrung haben, werden sich trotzdem dazu verpflichten diese Sterilisationen durchzuführen mit dem Resultat, dass viele weiblichen Tiere qualvoll sterben werden.
  • Z.B. in Arges: Alle weiblichen Hunde (ca. 500) die von einem Arzt, welcher durch den Bürgermeister beauftragt wurde, "sterilisiert" wurden, starben aber nach wenigen Tagen qualvoll auf den Straßen an den Folgen der unsachgemässen Sterilization. Ich stellte Strafanzeige und ich beschwerte mich bei der Ethik-Kommission der Hochschule für Tierärzte. Aber wie es sich entwickelte, trotz aller Erklärungen und ärztlicher Bescheinigungen von anderen Tierärzten, Mustern, Bildern oder Videos, scheint es, dass dieser „Arzt“ unschuldig ist und er wird auch weiterhin Hunde durch Sterilisationen töten.
  • Die Regeln bieten keine finanzielle Unterstützung von der Regierung für die Sterilisation von Hunden. Mindestens 4 Millionen Hunde leben in ländlichen Gebieten wo die Menschen nicht über die finanziellen Möglichkeiten verfügen und wo der Hund im Hof nicht als wichtig angesehen wird. Um Strafen und Steuern zu entgehen, werden die meisten Hunde dann in Plastiksäcke gesteckt, an Bäume im Wald gebunden werden, in stillgelegte Brunnen oder Bäche geworfen, entsprechend der alten Praxis um die nutzlos gewordenen Hunde zu entsorgen.

Die Behörden manipulieren mit ihrer Propaganda die Bevölkerung glauben zu machen, dass das Gesetz 258/2013 das "Gesetz der Adoption" und nicht ein "Schlachtgesetz" sei. In der Realität aber werden:

  • Dutzende von Menschen stehen bereits jetzt vor den Tierheimen um Hunde zu adoptieren, was ihnen aber nicht erlaubt ist
  • Das Gesetz sieht vor, daß, wenn Sie mehr als zwei Hunde adoptieren wollen, Sie die Erlaubnis von Ihrem Vermieter und den Nachbarn haben müßen
  • Die Häuser von Tierfreunden sind bereits jetzt voll von Hunden die von der Straße gerettet wurden und können nicht weitere hunderttausende von Hunden aufnehmen.
  • Einige Bürgermeister bedrängen und belästigen Menschen die Tiere im Haus halten, drangsalieren sie mit Geldstrafen im Namen von mißbräuchlichen lokalen öffentlichen Entscheidungen unter dem Vorwand Sie könnten Ihr Haustier nicht besitzen ohne die Zustimmung der Nachbarn und außerdem könnten Sie nicht mehr als zwei Haustiere halten.

Wer seinen Hund nicht innerhalb von 12 Monaten sterilisieren läßt wird eine Geldstrafe von bis zu 2.500 Euro zahlen haben (der Netto-Durchschnittslohn in Rumänien beträgt 350 Euro!)

Die Behörden werfen bewusst die Verantwortung für die Massentötung der Hunde den Tierfreunden vor, da diese nicht in den erforderlichen 14 Tagen die Hunde adoptiert haben! Auf diese Weise will man im Kopf aller die Schlußfolgerung einpflanzen, dass die Tierliebhaber die eigentlichen Schuldigen sind.

Destroying Dogs, Destroys People - Destroying People, Destroys Societies!

In the media we hear, we see discussed and analyzed only human victims of dogs.

Many Information regarding the huge number of bites caused by stray dogs are spread into the hospitals as rumors. Many of these reports are 'phantoms'. Untrue! The real cause of bites, actually involves dogs with owners and not stray dogs. Stray dogs seem to run continuously around people near dumpsters or innocently blocking them at the entrance to buildings or they sniff around the grocery bag of someone. The real atrocities committed by man on dog, the so called 'super human' full of 'consciousness', is not represented. It is not stated the disaster caused to people because of animal abuse. 

A study in Bistrita, made together with children between 14 and 15 years, under the leadership of Malcolm Plant, Researcher at the Faculty of Social Sciences and Law, University of Teesside, UK, with the support of the University of Denver, USA and the prestigious international organizations and academia from Europe and the U.S. and in collaboration with the Monitoring Team, showed that 86 % of children have seen animals abuse in public, and are affected by it. What then can we expect from the society? Tomorrow's adults often represents the traumatized children of today, who have learned that maltreatment is a normal act that need to proliferate it and apply it to your human kind!

It is never stated the trauma affecting moral citizens, compassionate, who cannot accept barbarism. We often exacerbate or invent facts going to the point that the stray dogs will destroy the Romanian population, therefore we need to destroy them first. But we are destroying the human right to have a healthy mind, to have the right to not hinder the right to be moral, compassionate, educated, civilized. 

Because it did not know and did not want to properly manage this situation, the state and local authorities sabotage the appreciable quality of people's lives in any civilized society, without regard to feelings and opinions, mistreating, torturing, killing the ones that have stood next to us for thousands of years, the animal. 

To save animals from the street, where irresponsible people throw them away and leave them to multiply, animal lovers have taken them in their homes, in their tiny apartments, sometimes beyond their financial and space capacities. It is natural that people with respect and compassion for dogs, who became stray dogs due to the ignorance of some owners and the disinterest / interest of the authorities, can not accept the killing. Killing or perspective of killing the dogs that they protect, protecting against the destruction of any hope that the society can be a civilization embracing the rules of morality. The financial interest of the authorities is deemed beyond anything and anyone's life and can affect so much that it can become fatal.

This is what happened to Avedis Ghazarian, 46, a balanced man with above average intelligence and wisdom, a man of moral principles, whose heart gave up on the same day when persuing the belief that animals, for whom he fought for years, may have some hope .

Avedis Ghazarian was killed by a sick, hollow, moral and spiritual infested system. Avedis is one of many, known for being active together with us, the ones who activate for same principles, but the lives of many people has stopped due to terminating actions of the dog catchers together with the ones coordinating them. Thousands of people have been affected mentally and spiritually hopelessly by the atrocities seen daily in the streets and in the extermination camps of the Romanian city halls. Millions of Romanian people do not accept the massive dog killing. Tragedy that nobody talks about, like it’s a secret! 

Avedis, we are sure that on your way to the world that now becomes yours, you will meet your voiceless friends, snatched, just like you, from this world, now left, for now just to us to seek to bring justice, change and hope... for animals, for the people and for the country of Romania. We embrace you and them! May you walk only through the light!

In den Medien hören und sehen wir, dass nur die menschlichen Opfer von Hunden diskutiert und analysiert werden. Viele Informationen bezüglich der Anzahl von Bissen durch streunende Hunde werden in den Krankenhäusern als Gerüchte gestreut. Viele dieser Berichte sind "Hirngespinste". Unwahr! Die eigentliche Ursache der Bisse betrifft Hunde und ihre Besitzer, nicht streunende Hunde. Streunende Hunde scheinen immer wieder in der Nähe von Müllcontainern um Menschen herumzulaufen, sie blockieren unschuldig Gebäudeeingänge oder schnüffeln an irgendjemandes Einkaufstüten.

Die wirklichen Gräueltaten, die Menschen Hunden antun - die sogenannten "Supermenschen mit dem richtigen Bewusstsein", werden nicht erwähnt. Es wird auch nicht darüber geredet, was Menschen durch Misshandlung der Hunde geschieht.

Eine Studie in Bistrita, Romania mit Kindern zwischen 14 und 15 Jahren, unter der Leitung von Malcolm Plant, Forscher der Faculty of Social Sciences and Law, University of Teesside, UK, zusammen mit der University of Denver, USA, und anderen prestigeträchtigen internationalen Organisationen und Akademien in Europa und den USA, in Zusammenarbeit mit dem Kontrollteam, zeigte, dass 86 % der Kinder Misshandlungen von Hunden in der Öffentlichkeit beobachtet haben und davon betroffen sind. Was können wir von der Gesellschaft erwarten? Die Erwachsenen von morgen werden hauptsächlich die traumatisierten Kinder von heute sein, die gelernt haben, dass Misshandlung normal ist, sich ausbreiten und auf die Menschen angewandt werden muss.

Niemals wird über das Trauma der anständigen, mitfühlenden Bürger berichtet, die Barbarei nicht akzeptieren können. Oft übertreiben oder erfinden wir Fakten dahingehend, dass streunende Hunde die rumänische Bevölkerung zerstören werden, deshalb müssten wir sie zuerst vernichten. Aber damit zerstören wir das Menschenrecht einen gesunden Geist zu besitzen, das Recht zu haben nicht zu verhindern, dass Recht anständig ist, mitfühlend, gebildet und zivilisiert. Weil sie weder wissen noch in der Lage sind, diese Situation angemessen zu bewältigen, sabotieren der Staat und die lokalen Behörden den beträchtlichen Wert von Menschenleben in einer zivilisierten Gesellschaft ohne Gefühle und Meinungen zu berücksichtigen, indem sie das Tier, das uns seit Tausenden von Jahren am nächsten stand, misshandeln, quälen und töten.

Um Tiere von der Straße zu retten, wohin sie von unverantwortlichen Menschen weggeworfen und der Vermehrung überlassen werden, haben Tierliebhaber sie in ihre Heime geholt, in ihre kleinen Wohnungen, manchmal über ihre finanziellen und räumlichen Möglichkeiten hinaus. Es ist selbstverständlich, dass Menschen mit Respekt und Liebe zu Hunden, die durch die Ignoranz einiger Besitzer und durch das Desinteresse/Interesse der Behörden zu Streunern wurden, das Töten nicht akzeptieren können. Das Töten oder die Aussicht auf das Töten der Hunde, die sie beschützen, beschützen gegen die Zerstörung jeglicher Hoffnung, dass eine Gesellschaft eine Zivilisation sein kann, die auf den Regeln des Anstands aufgebaut ist. Die finanziellen Interessen der Behörden sind außerhalb von alledem und jeglichen Lebens und können so sehr schaden, dass es verhängnisvoll werden kann.

Das ist Avedis Ghazarian, 46, passiert, einem ausgeglichenen Mann mit überdurchschnittlicher Intelligenz und Weisheit, einem Mann mit moralischen Prinzipien, dessen Herz am selben Tag aufgab, an dem er den Glauben lebte, dass Tiere, für die er seit Jahren kämpfte, etwas Hoffnung haben dürften.

Avedis Ghazarian wurde von einem kranken, hohlen und geistig verseuchten System getötet. Avedis ist einer von vielen, die dafür bekannt sind mit uns zusammen aktiv zu sein, einer von denen, die für dieselben Prinzipien handeln. Doch das Leben vieler Menschen wurde durch Tötungsaktionen der Hundefänger und die, welche sie koordinieren, beendet.

Tausende von Menschen sind durch die täglichen Gräueltaten auf den Straßen und in den Auslöschungs-Camps der rumänischen Rathäuser seelisch und moralisch beeinträchtigt und hoffnungslos geworden. Millionen von Rumänen akzeptieren diese massiven Hundetötungen nicht. Es ist eine Tragödie, über die niemand spricht, als ob es ein Geheimnis wäre.

Avedis, wir sind sicher, dass du auf dem Weg in die Welt, die jetzt die deine sein wird, deine sprachlosen Freunde treffen wirst, genau wie du dieser Welt entrissen, verlassen, die ihr nur noch uns habt, die versuchen Gerechtigkeit, Wandel und Hoffnung zu bringen... für Tiere, für Menschen und für das Land Rumänien. Wir umarmen euch und sie! Möget ihr nur durch das Licht gehen!
